Terms and Conditions

Section 1 - Definitions of Second-hand, Pre-loved or Pre-Owned Curtains

1.1 - Please note that with the exception of curtains that have come direct from a curtain maker the curtains that are listed for sale by Divinely Vintage Ltd are offered for sale as second hand/pre-loved/pre-owned and as such may show some signs of general wear and tear, see 1.2, 1.3 and 1.4 below.

1.2 - Divinely Vintage Ltd pays particular attention to the condition of the curtain(s) looking for discernible marks, stains or fading. If there is anything particularly significant, e.g. extreme fading, rips, holes etc., this will be described in the description part of the listing and photographic evidence of the relevant damage/fading etc. will be provided 

1.3 - Photographs are only an indication of colour and should be viewed in conjunction with the item description.

1.4 -  Second-hand means exactly that and therefore some superficial marks which can be associated with everyday use are to be expected but very often are not noticeable when the curtain(s) are hanging.

1.5 - Divinely Vintage Ltd, acting as agents for the owners of the curtains, is not responsible for having curtains dry-cleaned however we make every attempt to ensure curtains are in a sellable condition when they are offered for sale to customers. However as a buyer you should think about the possible cost of cleaning the curtains before you hang them.

Section 2 - Indemnity

2.1 - You agree fully to indemnify, defend and hold Divinely Vintage Ltd, its officers, directors, employees, agents and suppliers, harmless from and against all claims, liability, damages, losses, costs and expenses, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Divinely Vintage Ltd website, or the use by any other person accessing the Divinely Vintage Ltd website using your account or personal information.

Section 3 - Payment Terms
3.1 - Unless agreed otherwise, all payments must be made in sterling. Payments are primarily made using any of the following methods: Maestro, Visa Credit or Delta, Mastercard or American Express.
3.2 Divinely Vintage Ltd will also allow direct transfer into the Divinely Vintage Ltd bank account using the FPS method and details will be provided upon request.

Section 4 - Our Rights
4.1 - Divinely Vintage Ltd reserve the right to modify or withdraw the Divinely Vintage Ltd website (or any part thereof) with or without notice to you and you confirm that Divinely Vintage Ltd shall not be liable to you or any third party for modification to or withdrawal of the Divinely Vintage Ltd website: and/or change the conditions from time to time, and your continued use of the Divinely Vintage Ltd website or any part of it following such a change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any of the changes to the Terms and Conditions then you must immediately stop using the Divinely Vintage Ltd website.

Section 5 - Price
5.1 - While Divinely Vintage Ltd try to ensure that all prices on our Divinely Vintage Ltd website are accurate, errors may occur. If Divinely Vintage Ltd discover an error in the price of goods Divinely Vintage Ltd will notify you as soon as possible and give you the option of reconfirming your order at the correct price at or cancelling it. If Divinely Vintage Ltd are unable to contact you, Divinely Vintage Ltd will treat your order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Section 6 - Third Party Rights
6.1 - Except for Divinely Vintage Ltd affiliates, directors, employees or representatives, a person, who is not a party to this agreement has no right under the UK Contract (Right of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that act.
 
Section 7 - Governing law
7.1 - The contract between Divinely Vintage Ltd and its clients and customers shall be governed by and construed in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between Divinely Vintage Ltd and its clients and/or customers. English is the only language offered for the conclusion of the contract.

Section 8 - Entire Agreement
8.1 - These terms and conditions, together with our current Divinely Vintage Ltd website prices, delivery details, contact details and privacy policy, set out the whole of the agreement relating to the supply of the goods to you by Divinely Vintage Ltd. Nothing said by any sales person on behalf of the company should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by the company. Save for fraud or fraudulent misrepresentation, Divinely Vintage Ltd shall have no liability for any such representation being untrue or misleading.

Section 9 - Warranties and Liability
9.1 - Subject to the Terms set out Divinely Vintage Ltd warrant that upon delivery of the goods will correspond with their specification, will approximately correspond with the approximate description given by us and will be free from defect.
